LAHORE: A Lahore High Court (LHC) judge on Monday withdrew himself from hearing a petition questioning the validity of the recently passed 27th Constitutional Amendment.
Justice Chaudhry Muhammad Iqbal excused himself from the proceedings on personal grounds and sent the case to Chief Justice Aalia Neelam, who will now decide how to reassign the matter.
The petition, submitted by Munir Ahmed and several others and argued by Advocate Muhammad Azhar Siddique, names the federal government, including the prime minister and the National Assembly speaker, as respondents.
In their plea, the petitioners contend that the amendment undermines the Supreme Court’s authority by paving the way for the creation of a federal constitutional court. They claim the move weakens judicial independence and shifts powers away from the country’s top court.
The petition also argues that the amendment clashes with Islamic principles, fundamental rights, and the constitutional balance between the federation and provinces. It notes that stakeholders such as lawyers, civil society, and journalists were not adequately consulted.
The applicants have asked the LHC to suspend the amendment’s implementation and ultimately strike it down as unconstitutional.
